Welcome to Art.me, an art mobile application (“the App”). This document outlines the terms and conditions ("Terms") that govern your access to and use of our App, including its features like buying, selling, and trading art. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the App.

1. Account Registration and Anonymity

1.1 You must be at least 18 years old and capable of forming a legally binding agreement to access and use our App. By using our App, you represent and warrant that you meet these requirements.

1.2 To use certain features of the App, you may be required to register an account. We prioritize user anonymity and respect your privacy. Therefore, we do not require any personally identifiable information (such as real names, addresses, or contact details) during the registration process. You may choose a unique username or pseudonym to represent your identity on the App.

1.3 It is your responsibility to maintain the confidentiality of your account credentials and any information you choose to disclose within the App. You are solely responsible for any activity that occurs under your account, whether authorized or unauthorized.

1.4 You agree not to impersonate any other person, entity, or organization or falsely represent your affiliation with any person, entity, or organization while using the App.

1.5 We reserve the right to refuse registration, suspend, or terminate your account at our discretion, without prior notice, if we believe you have violated any provisions of these Terms or engaged in any fraudulent, abusive, or unlawful activities.

2. Buying, Selling, and Trading Art

2.1 Art listings on the App are created by users, and we do not verify the accuracy, authenticity, or legality of the artworks listed. As a buyer, it is your responsibility to conduct your own due diligence and make informed decisions while purchasing art through the App.

2.2 As a seller, you are solely responsible for the accuracy of the information, including images and descriptions, provided in your listing. You represent and warrant that you have the legal right to sell the artwork listed and that the artwork does not infringe upon any copyrights, trademarks, or intellectual property rights of any third party.

2.3 Buyers and sellers must communicate and conduct transactions solely through the App's messaging and payment systems. We strongly discourage sharing personal contact information or engaging in transactions outside of the App, as it may compromise user anonymity and the security of the transaction.

2.4 Art.me does not act as an intermediary or agent in any buying, selling, or trading transactions conducted through the App. We are not responsible for any disputes, losses, or liabilities arising from these transactions. However, we encourage users to notify us of any suspicious or fraudulent activities encountered while using the App.

2.5 Funds will be held in your Art.me wallet for a minimum of seven (7) days before you can request a withdrawal. This waiting period is to ensure the security and integrity of transactions on the platform.

3. Intellectual Property

3.1 All content, including but not limited to text, images, graphics, logos, and software, provided on the App, is the intellectual property of Art.me or its licensors. You acknowledge and agree to respect and abide by all copyright, trademark, and other proprietary rights associated with the content on the App.

3.2 By using the App, you retain ownership of any content you submit, upload, or post on the App, including artwork listings, comments, and messages ("User Content"). However, by uploading or posting User Content on the App, you grant Art.me a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, publicly display, and publicly perform your User Content in connection with the operation and promotion of the App.

3.3 You agree not to upload, post, or otherwise transmit any User Content that infringes upon the rights of any third party, including intellectual property rights, privacy rights, or publicity rights. Art.me reserves the right to remove any User Content that violates these Terms or is deemed inappropriate, offensive, or harmful.

4. Privacy Policy

4.1 Your privacy is important to us. We maintain a separate Privacy Policy that explains how we collect, use, and disclose your personal information. By using the App, you acknowledge and agree to our Privacy Policy.

5. Limitation of Liability

5.1 Art.me is provided on an "as is" and "as available" basis. We do not warrant or guarantee the accuracy, completeness, timeliness, reliability, or availability of the App or any content provided on the App. You acknowledge and agree that your use of the App is at your own risk.

5.2 In no event shall Art.me, its affiliates, employees, or directors be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way connected with your use of the App, whether based on contract, tort, strict liability, or any other legal theory.

6. Indemnification

6.1 You agree to indemnify and hold Art.me, its affiliates, employees, and directors harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, violation of these Terms, or infringement of any rights of third parties.

7. Modifications to the Terms

7.1 Art.me reserves the right to modify or update these Terms at any time, without prior notice. Any changes made to the Terms will be posted on the App, and it is your responsibility to regularly review the Terms for any updates. Your continued use of the App after the posting of the revised Terms constitutes your acceptance of the changes.

8. Termination

8.1 You may choose to terminate your account at any time by contacting us or through the account settings in the App. We also reserve the right to suspend or terminate your account, restrict access to the App, or remove any User Content without prior notice or liability, for any reason we deem necessary.

8.2 Upon termination, your rights to use the App will immediately cease, and you acknowledge that we may delete your account information and User Content from our databases. However, please note that certain information may persist and remain available even after termination, as required by law or for our legitimate business purposes.

9. Governing Law and Jurisdiction

9.1 These Terms shall be governed by and construed in accordance with the laws of [jurisdiction].
